Delivery Terms
Article 1. Applicability
1.1 All offers, orders, and agreements of Blue Circle Games are exclusively subject to these General Sales Conditions (hereinafter referred to as “Conditions”), to the exclusion of any other general conditions.
1.2 Accepting an offer or placing an order implies your acceptance of the applicability of these Conditions.
1.3 Deviations from these Conditions are only valid if agreed upon in writing, in which case the remaining provisions shall remain in full force.
1.4 All rights and claims stipulated in these Conditions and any further agreements for the benefit of Blue Circle Games are equally stipulated for intermediaries and other third parties engaged by Blue Circle Games.
Article 2. Offers/Agreements
2.1 All offers from Blue Circle Games are non-binding, and Blue Circle Games expressly reserves the right to change prices, especially when this is necessary based on (legal) regulations. See also Article 3.6.
2.2 An agreement only comes into effect after acceptance of your order by Blue Circle Games. Blue Circle Games is entitled to refuse orders or to attach certain conditions to the delivery unless explicitly stated otherwise. If an order is not accepted, Blue Circle Games will communicate this within ten (10) working days after receiving the order.
Article 3. Prices and Payments
3.1 The actual shipping costs, which prevail over what is mentioned below, will be displayed during checkout:
- Netherlands: Shipping for orders over €50 is free. For orders under this amount, shipping costs are €4.95.
- Belgium, Germany, France: Shipping for orders over €70 is free. For orders under this amount, shipping costs are €6.75.
- Other countries: shipping costs are €11,95.
3.2 Payment can only be made using iDEAL, Sofort, Bancontact & PayPal.
3.3 Blue Circle Games ensures the safe storage of your data using Secure Socket Layers (SSL), an advanced internet security system to protect your data. To guarantee the security of the ordering process, all data, including name, address, and credit card, is stored encrypted on a Secure Server. Most browsers support SSL, including Internet Explorer 2.1 or higher, Netscape Navigator 2.0 or higher, AOL 3.0 or higher. If you are not sure if your browser supports SSL, check the browser data with your Internet Service Provider (ISP).
3.4 In the unlikely event of misuse of your credit card number, please follow the instructions of your credit card company. We ask you to inform Blue Circle Games as soon as possible by sending an email to info@doublelucky7game.com. Most credit card companies cover all damage above a certain amount resulting from misuse of your credit card number.
3.5 If you fail to make any payment, Blue Circle Games is entitled to suspend (the execution of) the relevant agreement and related agreements or to dissolve them.
3.6 If the prices for the offered products and services increase in the period between the order and its execution, you have the right to cancel the order or dissolve the agreement within ten (10) days after the notification of the price increase by Blue Circle Games.
Article 4. Delivery
4.1 The delivery times specified by Blue Circle Games are indicative. Exceeding any delivery term does not entitle you to compensation, nor the right to cancel your order or dissolve the agreement, unless the delay is such that you can no longer reasonably be expected to maintain the agreement. In such a case, you are entitled to cancel the order or dissolve the agreement as far as necessary.
4.2 Delivery of products takes place on working days at the place and time when the products are ready for shipment to you. Orders placed on working days before 1:00 PM will be delivered the next day (within the Netherlands only). For international deliveries, we aim for delivery within 48 hours. Generally, our carrier does not deliver on Sundays and public holidays.
Article 5. Reservation of Ownership
5.1 Ownership of delivered products transfers only after you have fulfilled all that you owe under any agreement with Blue Circle Games. The risk concerning the products transfers to you at the moment of delivery.
Article 6. Intellectual and Industrial Property Rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights resting on the products delivered by Blue Circle Games. 6.2 Blue Circle Games does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.
Article 7. Right of Withdrawal and Liability
7.1 Upon delivery, you have the obligation to examine whether the products conform to the agreement. If this is not the case, you must notify Blue Circle Games as soon as possible and in any event within fourteen (14) days after delivery, or after observation was reasonably possible, in writing and motivated.
7.2 If it is demonstrated that the products do not conform to the agreement, Blue Circle Games has the option to replace the relevant products upon their return or to refund the invoice value.
7.3 If you do not wish to purchase a product for any reason, you have the right to return the product to Blue Circle Games within fourteen (14) days after delivery, without stating reasons, and dissolve the agreement. Returns are only accepted if the product’s packaging is undamaged, and the costs for return shipments are at your expense. You can return the product to the following address:

7.4 In case of withdrawal, we will refund all received payments, excluding delivery costs, without delay and in any case no later than 14 days from the day we are informed about your decision to withdraw from the agreement. We may wait with the refund until we have received the goods back, or you have shown that you have returned the goods, whichever comes first.
Article 8. Orders/Communication
8.1 Blue Circle Games is not liable for any misunderstanding, mutilations, delays, or improper transmission of orders and announcements resulting from the use of the Internet or any other means of communication in the traffic between you and Blue Circle Games, or between Blue Circle Games and third parties, insofar as it relates to the relationship between you and Blue Circle Games, unless there is intent or gross negligence on the part of Blue Circle Games.
Article 9. Force Majeure
9.1 Without prejudice to its other rights, in case of force majeure (such as natural disasters, war, strikes, pandemics), Blue Circle Games has the right to, at its own choice, suspend the execution of your order or dissolve the agreement without judicial intervention by notifying you in writing, without Blue Circle Games being obliged to any compensation, unless this would be unacceptable according to standards of reasonableness and fairness under the given circumstances.
9.2 Force majeure is understood to be any failure that cannot be attributed to Blue Circle Games, as it is not due to its fault and neither under the law, legal act, nor according to generally accepted standards.
Article 10. Miscellaneous
10.1 If you provide Blue Circle Games with a written address, Blue Circle Games is entitled to send all orders to that address, unless you provide Blue Circle Games with a written notice of another address to which your orders should be sent.
10.2 If Blue Circle Games has permitted deviations from these Conditions for a short or longer period, whether implicitly or not, this does not affect its right to demand immediate and strict compliance with these Conditions. You can never claim any right based on the fact that Blue Circle Games applies these Conditions flexibly.
10.3 If any provision of these Conditions or any agreement with Blue Circle Games is wholly or partially illegal, invalid, or otherwise unenforceable under applicable law, that provision or part of the provision will be deemed not to form part of these Conditions or the relevant agreement. However, this does not affect the validity and enforceability of the remaining provisions. Blue Circle Games will replace the relevant provision in such a case with a new provision, which retains as much as possible the intent of the original provision, but which is not illegal or invalid.
10.4 Blue Circle Games is authorized to engage third parties in the execution of your order(s).
Article 11. Applicable Law and Competent Court
11.1 All rights, obligations, offers, orders, and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law. 11.2 In the event of a dispute between you and Blue Circle Games, the parties will first attempt to resolve this dispute through mutual consultation. If the dispute cannot be resolved through mutual consultation, the parties may agree to submit the dispute to an independent mediator or an arbitration body for alternative dispute resolution before submitting the dispute to the judiciary. If alternative dispute resolution does not lead to a solution, or if the parties decide not to use alternative dispute resolution, all disputes will be submitted exclusively to the competent court in the Netherlands. This does not affect the right of Blue Circle Games to file a claim in any other competent court.
Article 12. Privacy Policy
12.1 Blue Circle Games commits to protecting and respecting the privacy of its customers. All personal data collected during the ordering process are processed in accordance with the EU General Data Protection Regulation (GDPR).
